| Please do not overload your vehicle. The total weight of personal belongings in your vehicle must not exceed 100 LBS. A surcharge will apply to overloaded vehicles. |
| All vehicles are subject to re-inspection at the time of loading. Such re-inspection will supersede all prior inspections. |

| US Auto Shippers will not be liable for the following: |
|

Damage caused by leaking fluids, battery acids, cooling system anti freeze solutions, rock chips, industrial fallout or fallout resulting from acts of god including but not limited to weather conditions. |
| » |
Unable to detect damage due to weather conditions or dirty condition of the vehicle. |
| » |
Damage caused by articles shipped inside the vehicle or damage caused by such articles while in shipment or damage and or fines resulting from overloaded vehicle. |
| » |
Any and all mechanical functions, and all electrical functions, exhaust, assembly, muffler, tailpipe, spoiler, fog lights, bumper guards, window shades, low under carriage alignment, transmission, suspension, drive train, engine, rear end, motor mount, wiring systems, window motors, radio, car phones, tape and CD player, stereo sound systems, power steering, airbag, brake cable or brake systems, antennae or power antennae systems and vehicle computerized systems (anything that is mechanical or electrical). Inspection of these items is not practical. |

Damage occurring while loading or unloading inoperable vehicles. Cost of expenses, including towing or repair charges, resulting from malfunction of vehicle. |

Damage or loss to any vehicle with a clearance of 8 inches or less from the ground. |

Damage to convertible, fabric, vinyl or removable tops or any damage caused by their failure. |
| » |
Damage to interiors including but not limited to dash boards, seals, carpeting and roof liners. |
| » |
Glass breakage by heat combustion, prior cracks, vandalism, road hazards, stone chips, dings, or flex. |
| » |
Damage to a vehicle resulting from another vehicle on the carrier’s equipment while being transported (i.e.: dripping fluids of loose parts) |
| » |
Auto rental accruals for any reason (delays, damage, claims or accidents). |
| » |
Damage due to road construction or road gravel damage, flying debris from roadway or overpass. Over the road dirt, diesel and truck oil residue. |
| » |
Inspection, condition or damage to tires, wheels or hubcaps. |
| » |
Damage resulting from tie-downs, breaking, tearing or flexing. |
| » |
Damage or claims on any vehicle shipped as is. |

| By Owner’s signature or Owner’s agent’s signature on the uniform straight bill of landing, the persons listed at the point of origin and the point of destination are appointed agents for the purposes of releasing the vehicle, approving charges accepting delivery and releasing carrier and agent from any and all claims upon acceptance of delivery. |

| Carrier or carrier’s agent shall only be liable to owner for any loss or damage to vehicle (not otherwise included) while vehicle is being loaded on the truck, carried on the truck, or being unloaded from the truck. |
|
| All monies tendered for payment must be in the form of a money order, certified check or in the case of delivery, cash may also be presented. Personal checks will not be accepted and an order will not be processed for vehicles subject to storage fees if such are at any point presented for payment. |
|
| The following items are not to be inside the vehicle at the time of shipment: Guns, explosives, ammunition, flammable products, narcotics, negotiable and legal papers, alcohol or jewelry. |
|
| Nothing in this agreement shall be constructed as making it binding on carrier to pick up and or delivery locations from or to which it is impractical to operate carrier’s equipment on account of conditions of highways, streets or other passageways or inadequate loading or unloading facilities, or local, state or federal laws. |
|
| If your vehicle is vandalized either during shipment or while awaiting shipment, carrier will not be held responsible. Owner will have to submit a claim to his own insurance company or absorb the loss if there is insurance. |
|
| Carrier will not knowingly transport any uninsured vehicle. If vehicle is not insured and owner fails to notify carrier of such, carrier will not be held responsible for any claims against owner or itself, and owner will be sued for any damages which may occur. |
|
| This agreement shall be construed according to the laws of the State of Florida. The parties agree that venue for any claim or controversy arising from or related to the agreement or the performance or breach thereof shall be exclusively laid and limited to the state court in and for Broward County, Florida. |
|
| In the event that any party institutes legal proceedings to enforce their respective right arising out of this agreement, the prevailing party shall be entitled to the award of the attorney’s fees and court costs, plus costs for executing, enforcing and or collecting all judgments at all trial and appellate levels. |
|
| This agreement supersedes all prior written or oral agreements and understanding between carrier and owner and constitutes the entire agreement between carrier and owner. This agreement shall not be modified except in writing by an officer of US Auto Shippers. |
|
| Fire, theft, and collision coverage will have benefit of any insurance in effect by the owner. Carrier’s responsibility for the described vehicle commences when the bill of landing is issued and signed by the driver and terminates when designated vehicle is signed for at destination. Shipper and or owner are subject to a $500 deductible. |
|
| Customer’s signature at origin is also for the following release. This will authorize carrier to drive my vehicle either at origin or destination between the point (s) of pick-up and delivery. |
|
| Please inspect your vehicle at the time of delivery and report any damages to our driver. The company will not honor damage claims made after delivery inspection. Claims must be made in writing within 5 days of delivery with photos of specific damages claims. |
|
| Carrier or agent does not guarantee pick up or delivery on specified dates or shipments, although carrier and agent will make good faith attempt to move the vehicle as promptly as possible and in accordance with shipper’s instructions. |
|
| All vehicles are shipped in accordance with the I.C.C. rules and regulations and any claims should be submitted directly to Carrier. |
|
| Carrier will make a good faith attempt to deliver vehicle to designated delivery point. However, owner acknowledges that due to circumstances beyond the control of the Carrier, a terminal may be used and the customer will have to pick up the car at that nearest terminal at their expense. |
|
| All vehicles over $25,000 in value will be co-insured with Owner unless additional insurance is purchased. All claims are subject to a $500 deductible. |
|
| All non operational vehicles tendered for transportation will be charged an additional $200. If a vehicle is rendered for shipment and later becomes non-operational for any reason, the $200 fee will be added onto the amount to be collected, as well as any other charges necessary to accomplish delivery. Owner may be required to pick up the vehicle at a terminal facility if additional fees are due upon delivery. |

| Shipper/Owner agrees that US Auto Shippers, a broker, reserves the right to broker this shipment through independent I.C.C. regulated trucking companies. As such, Shipper/Owner agree to file all claims for damage or disputes and any and all legal actions against the independent trucking company selected by US Auto Shippers Insurance information and I.C.C. authority are on file at US Auto Shippers and are available to shipper/owner requests. Shipper/Owner releases and holds harmless US Auto Shippers from any such damage claims. |

| Carrier shall not be liable directly, in subrogation or by assignment to Owner’s insurer for any payments made under owner’s insurance covering the vehicle while in Carrier’s possession. |
|
| US Auto Shippers insurance coverage is not in effect while the vehicle is at any terminal location or while it is being driven to or from points of loading or unloading. The same applies to any drop location. Your insurance is in full effect when the vehicle is not on the carrier. |
